This Electric Moped / Scooter Rental Agreement, Liability Waiver, and Release of Claims ("Agreement") is entered into by and between Roundup Delivered Rentals ("Company") and the renter identified below ("Renter"). By signing this Agreement, Renter agrees to all terms listed below.

5. AGE, ID, AND ELIGIBILITY REQUIREMENTS
Renter confirms that Renter is at least 18 years old and has provided a valid government-issued photo ID. Renter agrees that the rental item may only be used by the person signing this Agreement. Renter may not allow any other person to operate, borrow, ride, possess, or use the rental item without written permission from Company.

6. RENTAL PERIOD
The rental period is limited to the start date/time and return date/time listed in this Agreement. Rentals may be booked for a period of 1 to 14 days unless Company approves a different period in writing. Renter is responsible for returning the rental item on time.

7. RENTAL RULES AND REQUIREMENTS
- Renter must follow all local, city, county, state, and traffic laws.
- Helmet use is strongly recommended.
- No off-road use is permitted.
- No reckless riding, racing, stunts, towing, jumping, or unsafe operation.
- No operation while under the influence of alcohol, drugs, marijuana, medication, or any impairing substance.
- No passengers unless the rental item is specifically designed and approved for passenger use.
- Do not modify, tamper with, disable, remove, or bypass any part, lock, GPS, safety feature, brake, light, or control.
- Do not leave the rental item unsecured, abandoned, or unattended in an unsafe location.
- Rental item must be returned clean, on time, and in the same general condition as received, ordinary wear excepted.
- Renter must immediately notify Company of any accident, damage, theft, loss, malfunction, citation, or safety issue.

8. DAMAGE DEPOSIT
A refundable damage deposit of $150 is required before the rental item is released. The deposit may be refunded after the item is returned, inspected, and confirmed to be in good condition. Company may keep all or part of the deposit for damage, missing parts or accessories, excessive cleaning, late fees, failure to return, theft, loss, abandonment, violation of this Agreement, or any cost caused by misuse, negligence, or improper operation. If damage, loss, fees, or charges exceed the deposit amount, Renter agrees to pay the remaining balance.

9. LATE RETURNS
The rental item must be returned by the scheduled return date and time listed in this Agreement. Late returns will be charged $20 per day for each calendar day, or portion of a calendar day, past the scheduled return date/time. Late fees are in addition to any other amounts owed under this Agreement.

10. FAILURE TO RETURN / REPLACEMENT FEE
If the rental item is not returned within fourteen (14) calendar days after the agreed-upon return date and time, Renter agrees that the rental item shall be considered unreturned and subject to recovery efforts. In addition to all accrued rental charges, late fees, collection costs, court costs, attorney fees, and any other damages permitted by law, Renter agrees to pay a minimum replacement fee of Five Hundred Dollars ($500.00) per rental unit, or the actual replacement cost of the rental item, whichever is greater. Company reserves the right to pursue all available civil remedies and any other legal remedies permitted under Montana law for failure to return rented property. Renter remains responsible for all charges until the rental item is returned and accepted by Company or the full replacement cost and all related charges have been paid.

11. ASSUMPTION OF RISK
Renter understands that operating, riding, parking, transporting, or possessing an electric moped or scooter involves inherent and unavoidable risks, including but not limited to falls, collisions, road hazards, weather hazards, mechanical failure, actions of other drivers or pedestrians, property damage, serious injury, permanent disability, or death. Renter voluntarily accepts and assumes all risks connected to the rental item.

12. LIABILITY RELEASE AND WAIVER
To the fullest extent permitted by Montana law, Renter releases, waives, and agrees not to bring any claim against Roundup Delivered Rentals, Roundup Delivered, and their owners, officers, employees, drivers, contractors, agents, affiliates, successors, and assigns for any claims, damages, injuries, losses, expenses, or liability arising out of or related to the rental, possession, operation, transportation, use, parking, storage, or return of the rental item. This release includes claims related to personal injury, property damage, accidents, negligence, traffic violations, fines, citations, impound fees, towing fees, and third-party claims, to the fullest extent allowed by law.

13. INDEMNIFICATION
Renter agrees to defend, indemnify, and hold harmless Roundup Delivered Rentals, Roundup Delivered, and their owners, employees, contractors, agents, affiliates, successors, and assigns from any claims, damages, costs, attorney fees, fines, citations, injuries, losses, or expenses caused by or related to Renter's use, misuse, possession, operation, transportation, parking, storage, or failure to return the rental item.

14. FINES, TICKETS, VIOLATIONS, TOWING, AND IMPOUND
Renter is solely responsible for all tickets, citations, fines, parking violations, traffic violations, towing fees, impound fees, recovery fees, storage fees, or other charges incurred during the rental period or caused by Renter's use, possession, parking, or failure to return the rental item.

15. THEFT, LOSS, DAMAGE, OR ACCIDENT
Renter is fully responsible for the rental item from the time it is released to Renter until it is returned and accepted by Company. If the rental item is lost, stolen, damaged, abandoned, impounded, or not returned, Renter agrees to pay all repair costs, replacement costs, recovery costs, and related fees. Renter must immediately report any accident, damage, theft, loss, malfunction, or citation to Company.

16. INSPECTION BEFORE AND AFTER RENTAL
Renter agrees Renter had the opportunity to inspect the rental item before accepting it. Any pre-existing damage should be listed below before the rental item is released.

17. NO WARRANTIES
The rental item is provided as-is. Company makes no warranties, express or implied, beyond confirming that the item is believed to be in working condition at the time of release. Renter is responsible for using reasonable care and stopping use immediately if Renter believes the item is unsafe or malfunctioning.

18. PAYMENT AUTHORIZATION
Renter authorizes Company to charge the payment method provided for all amounts owed under this Agreement, including rental fees, damage deposit, late fees, delivery fees, setup fees if any, cleaning fees, repair costs, replacement costs, missing parts, fines, citations, towing, impound, collection costs, and any other charges authorized by this Agreement.

19. GOVERNING LAW, VENUE, AND JURISDICTION
This Agreement shall be governed by and interpreted under the laws of the State of Montana. The parties agree that any dispute, claim, lawsuit, collection action, or legal proceeding arising out of or related to this Agreement, the rental transaction, or the use, possession, or return of the rental item shall be brought in a court of competent jurisdiction located in Musselshell County, Montana. Renter expressly consents to the personal jurisdiction of the courts located in Musselshell County, Montana, and waives any objection to venue in those courts. Should Company prevail in any action to enforce this Agreement, recover unpaid charges, recover property, or collect damages, Renter agrees to pay all reasonable attorney fees, court costs, collection costs, investigation costs, and other expenses incurred by Company, to the extent permitted by law.

20. SEVERABILITY
If any part of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

21. ENTIRE AGREEMENT
This Agreement is the entire agreement between Company and Renter regarding the rental item. Any changes must be in writing and approved by Company.

22. RENTER ACKNOWLEDGMENT
